Introduction
[1] This is an appeal by appellant, (the plaintiff in the High Court) against the Court of Appeal's decision dated 18 August 2014. On 27 February 2014, the High Court had allowed the appellant's claim and dismissed the respondent's counterclaim (the defendant in the High Court). Dissatisfied with the High Court's decision, the respondent successfully appealed to the Court of Appeal against that decision.
[2] Leave to appeal was granted by this court on 28 April 2016. The question of law posed to us reads as follows:
"When a party on a certain date had confirmed the quantity and quality of the work done as having been completed to their satisfaction as per the contract and had authorised payment for such completed works, can that party resile from that position and mount a counter-claim based on alleged defective work or is the party now estopped from disputing such approval/authorisation."
