Ministerial Reference

[1] This is a Ministerial reference to the Industrial Court under s 20(3) of the Industrial Relations Act 1967 made on 6 June 2011 for an award in respect of the dismissal of ("the claimant") by Sarawak Energy Berhad ("the company/ respondent").

Facts

[2] Upon the application of the claimant, the court on 11 March 2016 ordered the Party Joined to be added as a party to this action. With the Party Joined added, the claimant was also ordered to amend his Statement of Case which he promptly did. The respondent filed its Amended Statement in Reply dated 22 April 2016 and the Party Joined its Statement in Reply dated 22 April 2016. The Rejoinder is dated 27 April 2016.

[3] The respondent and the Party Joined are both companies incorporated in Malaysia under the Companies Act 1965 and have the same registered office at 9th Floor, Menara Sarawak Energy, No 1, The Isthmus, 93050 Kuching, Sarawak.
