JUDGMENT

Application

[1] In this application for judicial review, the applicant is seeking to quash the Industrial Court's decision in the Industrial Court Case No: 1277 of 2016 dated 11 November 2016 (the "Award").

[2] The grounds of the application are: breach of natural justice (in respect of the decision of the Worker's Panel Member), excess of jurisdiction and that the Industrial Court had erred when it rejected the applicant's case for a restructuring.

[3] Having considered the application and the submission of the parties, this court has dismissed the application with costs.

The Salient Facts

[4] The applicant (the "Hotel") started operations in the 1960's whilst the 1st respondent is a trade union of employees (the "Union") established and registered under the Trade Union Act 1959.
